These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts and relevant statutory bodies (such as the Consumer Goods and Services Ombud).

3. Online Store Terms & Age Verification

By agreeing to these Terms of Service, you represent that:

  • You are at least 18 years of age or the age of majority in your province/country of residence, and possess the legal capacity to enter into a binding contract.

  • You will not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including but not limited to copyright laws).

  • You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services and potential order cancellation.

4. Accuracy, Completeness, and Pricing

  • Pricing Currency: All prices displayed on our website are in South African Rand (ZAR) and are inclusive of relevant local taxes (where applicable).

  • Price Adjustments: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue a Product or Service without notice.

  • Typographical Errors: In the event that a product is mistakenly listed at an incorrect price due to a system or typographical error, DriveSupply reserves the right to cancel or refuse any orders placed for the product listed at the incorrect price, in compliance with Section 23 of the Consumer Protection Act (CPA). If your card or bank account has already been charged, a full refund will be issued immediately.

5. Products, Bundles, and Warranties

  • Visual Representation: We make every effort to display as accurately as possible the colors and images of our products. However, we cannot guarantee that your computer monitor or phone display will show exact colors.

  • Standard Warranties: In accordance with Section 56 of the CPA, products sold by DriveSupply carry an automatic 6-month implied warranty against manufacturing defects. Defective items will be repaired, replaced, or refunded in line with our official Refund & Return Policy.

  • Misuse & Damage: Warranties do not cover damage caused by misuse, unauthorized modification, neglect, or failure to adhere to operating instructions.

6. Billing, Payments, and Account Information

  • Accepted Payment Methods: Payments are processed securely via our integrated third-party payment gateways (e.g., Paystack, Ozow, Yoco, PUDO, or Payfast).

  • Order Rejection: We reserve the right to refuse or limit any order placed with us (e.g., suspected fraudulent card activity).

  • Account Accuracy: You agree to provide current, complete, and accurate purchase and account information (including your delivery address, phone number, and email address) for all purchases made at our store so that we can complete your transactions and contact you as needed.

7. Delivery & Risk of Loss

Order delivery schedules, transit times (typically 3 to 10 business days), and shipping methods (including PUDO and Aramex) are governed by our Shipping & Delivery Policy. Risk of loss and title for items purchased pass to you upon successful delivery and signature handoff at your specified address.

8. Personal Information & POPIA Compliance

Your submission of personal information through the store is governed by our POPIA Privacy Policy. By placing an order, you acknowledge that your details will be processed securely for fulfillment and customer support purposes in accordance with the Protection of Personal Information Act 4 of 2013.

9. Intellectual Property

All content included on this site—such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software—is the property of DriveSupply or its content suppliers and is protected by South African and international copyright laws.

10. Limitation of Liability

To the maximum extent permitted by South African law, DriveSupply, its directors, employees, or suppliers shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from:

  • The use or inability to use our products or website.

  • Unauthorized access to or alteration of your transmissions or data.

  • Product failures resulting from improper usage, neglect, or non-compliance with product manuals.
